Community Skating Event Waiver Form Skater Name * First Name Last Name Parent's Name (if skater is under 18 yrs old) First Name Last Name Parent Email * Parent Cell Number/ Number to Call in Case of Emergency (###) ### #### RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT *For Skaters* In consideration for using and utilizing ice time and participating in ice skating activities of Premier Skating Academy, I fully agree to the following: This is a legally binding Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement (collectively, “Release”), made voluntarily by me, the undersigned Releasor, on my behalf, and on behalf of my heirs, executors, personal representatives, legal representatives, assigns, and next of kin to Premier Skating Academy, as the undersigned Releasor, I acknowledge and fully understand that there are dangers and risks to which I may be exposed by participating in ice skating activities. These dangers and risks include bodily injury, permanent disability, paralysis and death. These dangers and risks may be caused by my own actions, inactions, the actions of other participating in ice skating activities, the condition in which the activity takes place, or the negligence of the “Releases” named below. There may be other risks and social and economic losses either not known to me or not readily foreseeable at this time, and I fully accept and assume such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the activity. I hereby release, discharge, covenant not to sue, and agree to indemnify and save and hold harmless its owners, employees, agents, other participants, event sponsors, and if applicable, owners and leasers of the premises on which the activity takes place (each considered one of the “Releasees” herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the “Releasees” or otherwise. I have read this agreement, fully understand its terms, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance or any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law. I further agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect. The undersigned hereby agrees, represents, and warrants that neither the undersigned nor such participating child shall visit or utilize the facilities, services, and programs if he or she (i) experiences symptoms of COVID-19, including, without limitation, fever, cough or shortness of breath, or (ii) has a suspected or diagnosed/ confirmed case of COVID-19. The undersigned or participating child agrees to notify Premier Skating Academy immediately if he or she believes that any of the foregoing access/use restrictions may apply. The undersigned further acknowledges and agrees that, due to the nature of the facilities, services, and programs offered by Premier Skating Academy, social distancing of 6 feet per person may not be possible at all times and during on-ice activity. The undersigned fully understands and appreciates both the known and potential dangers of utilizing the facilities, services, and programs; and acknowledges that use thereof by the undersigned and/or such participating children may, despite Premier Skating Academy reasonable efforts to mitigate such dangers, result in exposure to COVID-19, which could result in quarantine requirements, serious illness, disability, and/or death. Intending to be legally bound, I hereby certify that: And I, the Minor’s parent and/or legal guardian, understand the dangers and risks of participating in ice skating activities and the Minor’s experience and capabilities and believe the Minor to be qualified, in good faith, and in proper physical condition to participate in these activities. I hereby release, discharge, covenant not to sue, and agree to indemnify and save and hold harmless each of the “Releasees” named above from all liability, claims, demands, losses, or damages on the Minor’s account caused or alleged to be caused in whole or in part by the negligence of the “Releasees” or otherwise. I further agree that if, despite this release, I, the Minor, or anyone on the Minor’s behalf makes a claim against any of the “Releasees” named above I will indemnify, save, and hold harmless each of the “Releasees” from any litigation expenses, attorney fees, loss liability, damage, or any cost that may incur as the result of any such claim. * I understand and agree I understand that skater's unstable on their feet should wear a helmet on the ice. * Hockey helmet, bike helmet and scooter helmets all work!
